Terms of Service

Effective date:

1) Acceptance

These Terms of Service (“Terms”) govern your use of the RapidUptime website and any related services (collectively, the “Services”). By accessing the website, submitting information, or calling any phone number displayed on the site, you agree to these Terms. If you do not agree, do not use the Services.

2) What RapidUptime does

RapidUptime is a marketing and routing service. We connect consumers with independent third‑party service providers (“Providers”) who may offer quotes, services, or information. RapidUptime is not a motor carrier and does not transport vehicles.

3) Third‑party Providers

Providers are independent businesses. Any quote, contract, service level, insurance, licensing status, pricing, transit time, and availability are determined by the Provider, not RapidUptime. You are responsible for confirming that any Provider is suitable for your needs.

4) Communications & call recording

Calls may be monitored or recorded for quality assurance, training, fraud prevention, and dispute resolution, where permitted by law. If you prefer not to be recorded, you may disconnect and contact us at ops@rapiduptime.com.

5) Your responsibilities

  • Provide accurate information when requesting a quote or service.
  • Do not misuse the Services (including attempting to interfere with routing, tracking, or operations).
  • Use the Services only for lawful purposes.

6) No guarantees

RapidUptime does not guarantee that you will receive a quote, that a Provider will accept your job, or that any quoted price will remain available. Market conditions and Provider capacity change frequently.

7) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAPIDUPTIME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

8) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAPIDUPTIME WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PROVIDER. TO THE EXTENT RAPIDUPTIME IS FOUND LIABLE FOR ANY CLAIM, RAPIDUPTIME’S TOTAL LIABILITY WILL NOT EXCEED $100.

9) Indemnification

You agree to defend, indemnify, and hold harmless RapidUptime from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your dealings with any Provider.

10) Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles.

11) Changes

We may update these Terms from time to time. If we make changes, we will update the effective date above.
